Yes, Apple would allow this sort of app on the appstore without issue. However, I have a friend who created one similar to what you are talking about it and it got rejected. That is because originally the app was primarily the same as the web site for the restaurant. Apple said there wasn't any "value added" in the app. So he added a feature to "favorite" a menu item. The app was accepted.
As for Developer Account, it depends on how much control you or the client wants to have over the release process. Doesn't really matter to Apple who's account it's under.
